Terms of Service

These terms are an agreement between you and PathForward Financial (“PathForward”, “we”, “us”) covering your use of our website and application. By creating an account or using the service, you agree to them. If you do not agree, do not use the service.

1. What PathForward is — and what it is not

PathForward is software for organising your own money. It helps you build a budget, track debts and savings, plan payoff strategies, and see your net worth over time.

PathForward is not a financial adviser. We are not a bank, credit union, lender, broker-dealer, insurance agency, tax preparer, or registered investment adviser. Nothing in the application is personalised financial, investment, tax, or legal advice. Educational content, rules of thumb, calculators, and suggested sequences are general information only. See our Financial Disclaimer, which forms part of these terms.

4. Connecting a bank account

Bank connections are optional and provided through Plaid Inc. By connecting an account you authorise us to retrieve account balances and transaction history through Plaid on your behalf.

5. Household sharing

You may invite another person into your budget. Understand clearly what this does: the person you invite can read and change your financial data, including income, expenses, debts, savings, and any synced bank transactions. You are responsible for who you invite. Either party may end the arrangement at any time.

7. Your content and our software

Your data stays yours. You keep all rights to the financial information you enter. You grant us only the limited licence needed to store, process, and display it back to you and to anyone you have invited.

We may use fully anonymised, aggregated statistics — for example, how many users are on each plan — to operate and improve the service. Such data can never identify you.

The application, its design, and its content are ours and are protected by intellectual property law. These terms grant you a personal, non-exclusive, non-transferable, revocable right to use the service; they transfer no ownership.

8. Disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure; that calculations, projections, or estimates will prove accurate; that data retrieved from your bank will be complete or timely; or that using the service will improve your financial position.

Every financial decision you make is your own. Verify important figures against your bank, your statements, and a qualified professional.

9. Limitation of liability

To the maximum extent permitted by law, PathForward and its owner are not liable for indirect, incidental, special, consequential, or punitive damages; for lost profits, lost savings, or lost data; for financial losses arising from decisions you made using the service; or for the acts or failures of Plaid, Stripe, Google, or your bank.

Our total liability for any claim relating to the service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

10. Indemnity

You agree to indemnify PathForward against claims arising from your misuse of the service, your violation of these terms or of any law, or your infringement of a third party’s rights.

11. Ending the agreement

You may stop using the service and delete your account at any time from Settings → Account. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the service — in which case we will give reasonable notice and an opportunity to export your data.

On termination your right to use the service ends immediately. Sections 7 through 10 survive.

12. Changes

We may update these terms. Material changes will be notified in the application or by email at least 30 days before taking effect. Continuing to use the service afterwards means you accept the revised terms.

13. Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Adams County, Colorado, and you consent to their jurisdiction.
